Federal Judge Orders Planned Parenthood to Pay $1.3 Million in Legal Fees and Other Expenses
DES MOINES, Iowa – An Iowa federal judge has ordered the abortion provider Planned Parenthood of the Heartland to pay more than $1.3 million in legal fees and other expenses, after finding Planned Parenthood had misrepresented the legal position it adopted in a lawsuit it filed against Iowa’s and several other states’ Republican Attorneys General, the Justice Department announced today.
U.S. District Judge Charles Rogers, who also awarded costs and attorneys’ fees to the Republican Attorneys General, ruled that Planned Parenthood failed to give the states the legal position it claimed to adopt in the lawsuit, instead adopting a much different legal position it used in the course of litigation. The judge ordered the abortion provider to pay the legal fees incurred by the Attorneys General for defending their lawful actions against the provider.
"Today’s ruling is a significant victory for the Attorneys General and citizens in Iowa and across the country who will benefit from this victory," said Dana F. Coakley, Assistant Attorney General for the Justice Department’s Civil Division. "The federal judiciary is charged with the protection of citizens’ constitutional rights and ensuring that every citizen’s constitutional rights are enforced. We will continue to stand up for the rule of law and the rights of all people."
According to the ruling, the government’s litigation of Planned Parenthood’s position that the Affordable Care Act’s requirement that abortion coverage be made available to all insured women must be enforced nationwide was costly and wasteful.
